Commons registration forms and fees

Every application under Part 1 of the Commons Act 2006 must be made in writing on a form provided by the Secretary of State for an application of that type, signed by every applicant or their representative and posted to Commons Registration Service, Lady Gillford's House, Petteril Bank Road, Carlisle, CA1 3AJ. 

For any applications seeking to amend the rights section of the register, we require a separate application for each entry to be amended, the exception being when the same set of rights is exercisable over multiple commons.

Forms and fees

Section 6 of the 2006 Act

Fill out form CA1 and send payment for the amount indicated if you want to:

• create a right of common resulting in the registration of new common land (no fee)
• create a right of common over existing common land (£292)

Section 7 of the 2006 Act

Fill out form CA2 and send payment for the amount indicated for a:

• variation a right of common (£292)
• variation a right of common resulting in the registration of new common land (no fee)

Section 8 of the 2006 Act

Fill out form CA3 and send payment for the amount indicated if you want to:

• apportion a right of common (£292)

Section 10 of the 2006 Act

Fill out form CA4 and send payment for the amount indicated if you want to:

• attach a right of common (no fee)

Section 11 of the 2006 Act

Fill out form CA5 and send payment for the amount indicated if you want to:

• re-allocate attached rights (£292)

Section 12 of the 2006 Act

Fill out form CA6 and send payment for the amount indicated if you want to:

• transfer a right in gross (£119)

Section 13 of the 2006 Act

Fill out form CA7 and send payment for the amount indicated if you want to:

• surrender or extinguish a right of common (£236)

Schedule 4, paragraph 8

Fill out form CA8 and send payment for the amount indicated if you want to:

• register a statutory disposition pursuant to section 14 of the 2006 Act, including the exchange of land for land subject to a statutory disposition (£437)

Section 15 of the 2006 Act

Fill out form CA9 and send payment for the amount indicated if you want to:

• register a new town or village green other than by the owner (no fee)
• register a new town or village green by the owner (no fee)

Section 19 of the 2006 Act

Fill out form CA10 and send payment for the amount indicated if you want to:

• request a correction, for the purpose of section 19(2)(a) of the 2006 Act (of a mistake made by the registration authority) and 19 (2)(c) removing a duplicate entry from the register (no fee)
• request a correction, for a purpose described in section 19(2)(b), or (e)
• request a correction, for a purpose described in section 19(2)(d)

Schedule 1, paragraph1(6)(b), to the 2006 Act

Fill out form CA11 and send payment for the amount indicated for:

• severance by transfer to public bodies (£235)

Schedule 1, paragraph 3(7)(b), to the 2006 Act

Fill out form CA12 and send payment for the amount indicated for:

• severance authorised by order (£235)

Schedule 2, paragraph 2 to 9, of the 2006 Act

Fill out form CA13 and send payment for the amount indicated for:

• non-registration of common land or town or village green (no fee)
• waste land of a manor not registered as common land (no fee)
• a town or village green wrongly registered as common land (no fee)
• deregistration of certain land registered as common land or as a town or village green (£1446)

Schedule 3, paragraph 2, to the 2006 Act: application made during the transitional application period

Fill out form CA14 and send payment for the amount indicated if you want to:

• surrender or extinguish of a right of common (£292)
• vary a right of common (£520)
• apportion a right of common to facilitate any other purpose (£461)
• request a severance of a right of common (£292)
• transfer a right in gross (£292)
• request a statutory disposition, including the exchange of land for land subject to a statutory disposition (£520)

Regulation 43

Fill out form CA15 and send payment for the amount indicated if you want to:

• declare entitlement to exercise a right of common (£77)

How to pay

We accept payments by cheque made out to Westmorland and Furness Council. If you prefer to pay by debit or credit card, or BACS, you can request to be invoiced instead.
